ITC and Federal Circuit Deny Motion for Stay:
ITC Exclusion Order Now Prohibits Importation of Infringing Digital Televisions
OSAKA – Funai Electric Co., Ltd. announced today that the International Trade Commission (“ITC”) and the Court of Appeals for the Federal Circuit (“Federal Circuit”) both have denied motions to stay the ITC’s remedial orders that were filed by VIZIO and others. These rulings mark a major achievement in Funai’s quest to end patent infringement by VIZIO and other television manufacturers.
The Federal Circuit had previously issued a temporary stay so that it could consider the parties’ briefs on whether a permanent stay should be entered pending the appeal of the ITC’s exclusion order. The Federal Circuit lifted the temporary stay and ruled “that Vizio has not met its burden to obtain a stay of the judgment” of the ITC. The Federal Circuit stated that “the provision in our earlier order that the bonding provisions of the [Limited Exclusion Order] and cease and desist order would remain in effect until further notice is lifted.” Customs must now fully enforce the ITC’s exclusion order against the digital televisions manufactured by VIZIO, TPV and the other Respondents in the ITC investigation as required by law.
Funai is committed to respect the intellectual property rights of other parties and will continue to vigorously protect its intellectual property rights against infringers. The lifting of the stay and the full enforcement of the ITC’s exclusion order is in accord with the US patent process and Funai’s achievement at the ITC.
